Terms of Service

Effective 12 September 2026. Operator: Adaptive Solutions, LLC, the entity publishing this MelaPlatform instance (“Operator”), reachable at hello@melaplatform.com, Raleigh, North Carolina, USA.

These terms are a working contract for this product. They are not a substitute for advice from a lawyer licensed in your state. Have counsel review them before you take live card payments or process other people’s customer data at scale.

1. What you are buying

A MelaPlatform license is a limited, non-exclusive, non-transferable, revocable right to use the MelaPlatform application for the seat count and paid term shown at checkout. You do not purchase the source code, trademarks, training data, or any Salesforce intellectual property. MelaPlatform is an independent product. It is not affiliated with, endorsed by, or a substitute for Salesforce, Inc.

2. What the product is — and is not

MelaPlatform is browser software. Org records are stored in the user’s browser (localStorage / IndexedDB) on the device that signed in, unless the Operator later attaches a separate hosted database. It is not a multi-region enterprise host, not a guaranteed SMTP or telephony provider, and not a PCI card vault.

Marketing comparisons to other CRMs describe product design. They are not a warranty that MelaPlatform replaces every feature, certification, or compliance program of those vendors.

3. Eligibility

You must be 18 or older and able to form a contract. You may not use MelaPlatform to collect personal information from children under 13 (COPPA) or to store government IDs, full payment-card numbers, Social Security numbers, PHI, or student records unless you have a separate written BAA / DPA and a lawful basis.

4. Customer data you put in the org

You are the controller of records you type or import (leads, contacts, cases, files). You represent that you have a lawful basis to process that data and that you will not upload content that is illegal, infringing, or someone else’s confidential information without permission. The Operator processes checkout identity (name, work email, company, plan) to issue licenses.

5. Payments, taxes, chargebacks

Cards are processed by Stripe, Inc. MelaPlatform pages do not store card numbers. Prices are listed in USD and are annual prepaid unless stated otherwise. Applicable sales, use, or VAT taxes are extra unless Stripe Tax is enabled and shown at checkout. Until tax collection is configured, the buyer is responsible for self-assessing tax where required. Chargebacks filed without first requesting a refund under the Refund Policy may result in license suspension.

6. Acceptable use

No scanning, attacking, or overloading the host. No resale of seats above your license. No spam. No use that violates export control, sanctions, or anti-bribery law. The Operator may suspend an instance that is being used to harm others.

7. Intellectual property

The MelaPlatform name, UI, and original code are the Operator’s. Sample records in a new org are fictional illustrations. You keep ownership of your customer records. Feedback you send may be used to improve the product without payment to you.

8. Disclaimer and limit of liability

THE SOFTWARE IS PROVIDED “AS IS.” THE OPERATOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE OPERATOR DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT THE PRODUCT MEETS A REGULATORY CERTIFICATION (SOC 2, HIPAA, FedRAMP, ISO 27001) UNLESS A SEPARATE WRITTEN ADDENDUM SAYS SO.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE PRODUCT IS LIMITED TO THE FEES YOU PAID FOR THE THEN-CURRENT LICENSE TERM. THE OPERATOR IS NOT LIABLE FOR LOST PROFITS, LOST DATA, OR INDIRECT DAMAGES. SOME STATES DO NOT ALLOW THESE LIMITS; IN THOSE STATES THE LIMIT IS THE MINIMUM THE LAW ALLOWS. NOTHING HERE LIMITS LIABILITY FOR FRAUD OR FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE WHERE THAT LIMIT IS UNENFORCEABLE.

9. Indemnity

You will defend and indemnify the Operator against claims arising from your customer data, your marketing claims about your own use of MelaPlatform, or your violation of these terms or the law.

10. Term and termination

The license lasts for the paid term. Either party may terminate for material breach uncured after 15 days’ notice. On termination you must stop using the software. You may export your org JSON before the term ends. The Operator may delete inactive browser data and is not a records-retention vendor.

11. Governing law

These terms are governed by the laws of the State of North Carolina, excluding conflict-of-law rules. Exclusive venue is the state or federal courts sitting in North Carolina, except that the Operator may seek injunctive relief anywhere. If a court finds a clause unenforceable, the rest remains in force.

12. Changes

Material changes will be posted on this page with a new effective date. Continued use after the date is acceptance. Questions: hello@melaplatform.com.
